集客AIアシスタント Terms of Service

Article 1. Scope

These Terms apply to all relationships between us and users concerning the use of the Service. If we and a user have concluded a separate agreement concerning the Service and it differs from these Terms, the separate agreement prevails.

Article 2. Definitions

1. "User" means a restaurant or other business that uses the Service, and its staff.
2. "Restaurant" means a restaurant the user has registered with the Service.
3. "Connection" means the user authorizing the Service to manage their Google Business Profile through their Google Account.
4. "Draft" means a proposed post or reply that the Service creates using AI.

Article 3. Getting started

1. Users start using the Service by adding the Service's LINE Official Account as a friend and registering a restaurant.
2. Users use the Service for business purposes.
3. We may refuse use if registration details are false or if we otherwise consider use inappropriate.

Article 4. The Service

The Service provides the following features. We may change the Service to improve it.

1. Delivering on LINE a summary of the restaurant's status compared with nearby restaurants of the same type (rank, star rating, number of reviews, new reviews, and so on)
2. Creating drafts of posts for Google Business Profile and publishing them when the user approves
3. Creating drafts of replies to reviews of the restaurant and posting them when the user approves

Article 5. Third-party services

1. The Service is provided using third-party services, including LINE provided by LY Corporation, and Google Maps, Google Business Profile, and the Gemini API provided by Google LLC.
2. Users must comply with the terms and policies of those services, including the LINE Terms of Use, the Google Business Profile guidelines, and the Google Maps user contributed content policy.
3. We are not responsible if all or part of the Service cannot be provided because of changes to, suspension of, or failures in third-party services.
4. The Service is provided independently by us and is not provided or endorsed by LY Corporation or Google LLC.

Article 6. Connecting your Google Account

1. Connecting is optional. Posts and replies are available only after connecting.
2. Users may connect only Google Business Profiles they are legitimately authorized to manage.
3. The Service publishes posts and replies only after the user reviews and approves them on LINE. The Service never publishes posts or replies automatically without the user's approval.
4. When the Service publishes a post or reply, it notifies the user of the result on LINE.
5. Users can disconnect at any time from the LINE menu or their Google Account settings. How information is handled after disconnecting is described in the Privacy Policy.

Article 7. AI-generated drafts

1. Drafts are created by AI, and we do not guarantee that their content is accurate, complete, or lawful.
2. Users review drafts and approve posts and replies at their own discretion and responsibility.
3. Users are responsible for the content of posts and replies published with their approval.

Article 8. Prohibited conduct

When using the Service, users must not:

1. Violate laws or public order and morals
2. Post false, exaggerated, or misleading content
3. Infringe the rights or reputation of others, or post defamatory content
4. Manipulate review ratings, including posting reviews themselves or through others, requesting reviews in exchange for payment or benefits, asking reviewers to include specific content, or selecting whom to ask for reviews in order to avoid negative ones
5. Connect restaurants or accounts they are not authorized to manage
6. Access the Service without authorization, place excessive load on it, or interfere with its operation
7. Copy, modify, or reverse engineer the Service
8. Provide benefits to antisocial forces
9. Engage in any other conduct we consider inappropriate

Article 9. Fees

Fees for the Service and payment methods are set out in a separate agreement between us and the user.

Article 10. Changes, suspension, and termination of the Service

1. We may suspend all or part of the Service for system maintenance, failures, changes to third-party services, natural disasters, or other unavoidable reasons.
2. We may end all or part of the Service after giving users reasonable notice.

Article 11. Suspension of use

If a user violates these Terms, we may suspend all or part of their use of the Service or disconnect their account without prior notice.

Article 12. Disclaimer of warranties

1. We do not guarantee that using the Service will achieve any particular result, such as a ranking in search results, a number of visitors, or sales.
2. We do not guarantee that information obtained from third-party services is accurate or up to date.

Article 13. Limitation of liability

Except in cases of our intent or gross negligence, our liability for damages incurred by a user in connection with the Service is limited to direct and ordinary damages, up to the total fees the user paid us for the Service in the 12 months before the month in which the damages occurred.

Article 14. Exclusion of antisocial forces

Users represent and warrant that they are not, and will not become, organized crime groups, their members or affiliated companies, corporate extortionists, or other antisocial forces. If a user breaches this, we may suspend their use of the Service without notice.

Article 15. Personal information

We handle information obtained through the use of the Service in accordance with our Privacy Policy.

Article 16. Ending your use

Users can stop using the Service at any time by blocking or unfriending the LINE Official Account and disconnecting their Google Account. How information is handled after users stop using the Service is described in the Privacy Policy.

Article 17. Changes to these Terms

We may change these Terms in accordance with Article 548-4 of the Civil Code of Japan. When we do, we will announce the changed content and its effective date on the Website or by other appropriate means before the effective date.

Article 18. Notices

We send notices to users by LINE message, email, posting on the Website, or other means we consider appropriate.

Article 19. No assignment

Users may not assign or pledge their position under these Terms, or their rights and obligations under these Terms, to any third party without our prior written consent.

Article 20. Governing law

These Terms are governed by the laws of Japan.
